These Terms of Service (“Terms”) govern your use of smarterinstant.com (the “Site”) and any purchase from SmarterInstant (“we”, “us”, or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility. You must be at least 18, or the age of majority in your jurisdiction, and able to form a binding contract.
Products and pricing. We work to describe and price products accurately but do not warrant that descriptions, images, specifications, or prices are error-free. All prices are in US dollars and may change without notice. If a product is listed with an incorrect price or information, we may cancel any order for that product, even after confirmation, and issue a full refund.
Orders. Your order is an offer to buy. We may accept or decline it and may limit or cancel quantities. An order confirmation email does not guarantee acceptance; a contract forms only when we ship. If we cancel after payment, we issue a full refund.
Payment. Payment is due at checkout through our approved payment providers. By paying, you confirm you are authorised to use the payment method. Where a pay-over-time or financing option is offered at checkout, it is provided by a third-party finance provider and is subject to that provider’s approval, rates, and terms — not ours.
Intellectual property. All Site content is owned by or licensed to us and protected by law. You may not copy or reuse it commercially without written permission. Product names and trademarks referenced on the Site remain the property of their respective owners.
Acceptable use. You agree not to use the Site unlawfully, interfere with its operation, attempt unauthorised access, or submit false information.
Warranties and disclaimers. Products are covered by the manufacturer warranty stated on the relevant product page and by our Refund & Returns Policy. Except as expressly stated, the Site and products are provided “as is” to the fullest extent permitted by law.
Limitation of liability. To the maximum extent permitted by law, SmarterInstant is not liable for indirect, incidental, or consequential damages. Our total liability for any claim will not exceed the amount you paid for the product at issue.
Governing law. These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Florida.
Changes. We may update these Terms; continued use after changes are posted is acceptance.
